The Kroger Co. and Affiliates E-Sign Consent

The Kroger Co. and its affiliates and third party service providers (“Kroger”, “we”, “us” or “our”) may need to provide you with certain communications in writing regarding the Kroger Rewards Debit Card (the “Card”). By clicking or tapping “I agree,” you agree to and are electronically signing this The Kroger Co. and Affiliates E-Sign Consent (“Consent”). We may amend the Consent at any time by posting a revised version on our website and/or via email to your primary email address provided with your Card application or any update thereto. The revised version of this Consent will be deemed accepted by you and become effective when you first use the Card after the posting of the revised Consent at www.kroger.com/f/rewards-debit-card-econsent; or, if sooner, 30 days after we email you notice of the revisions. 

A. Electronic delivery of communications

You agree and consent to receive electronically all communications, agreements, documents, notices and disclosures (collectively, “Communications”) that we provide in connection with your Card. All electronic Communications we provide to you will be considered “in writing”. Communications include:

• application for the Card;

• agreements and policies related to the Card (e.g., Kroger Rewards Debit Card Agreement and the Kroger Financial Privacy Policy), including updates to these agreements or policies;

• annual disclosures;

• receipts or confirmations for transactions with your Card;

• transaction histories and any other Card-related transaction information; and

• all other disclosures, notices, documents and other communications in connection with applying for, opening or using a Card.

We may provide these Communications to you by posting them on the www.Kroger.com/RewardsDebitCard and/or by emailing them to you at the primary email address provided in your application or the most recent update of your primary email address that you have provided to us.

B. Hardware and software requirements

In order to access and retain electronic Communications, you will need the following computer hardware and software:

• a computer with an Internet connection;

• a current version, or one of the two most recent versions, of the following software applications:

• a web browser (e.g. Internet Explorer, Firefox, Chrome, or Safari) with cookies enabled;

• Adobe Acrobat Reader to open documents in .pdf format;

• a valid email address (your primary email address on file with us); and

• sufficient storage space to save past Communications or an installed printer to print them.

By agreeing to this Consent, you are confirming that you have access to the necessary equipment and are able to receive, open, and print or download a copy of any Communications for your records. You should print, download or otherwise save a copy of these Communications for your records as they may not be accessible online at a later date. We will notify you if there are any material changes to the hardware or software needed to receive electronic Communications from us.  

C. How to withdraw your consent

You may withdraw your consent to receive electronic Communications by calling us at 1-877-300-7797, or writing to us at:

Because we communicate electronically, you must provide your consent to receive Communications electronically in order to apply for and obtain a Card and receive our Card-related services. If you fail to provide your consent to receive Communications electronically, we may decline to approve your application for a Card and if you withdraw your consent to receive Communications electronically, we will cancel your Card and terminate your use of our Card-related services. 

D. Requesting paper copies of electronic Communications

If, after you consent to receive Communications electronically, you would like a paper copy of a Communication we previously sent you, you may request a paper copy by calling us at 1-877-300-7797, or writing to us at:

We will send your paper copy to you by U.S. mail to the home address you provided in your Card application or the most recent update thereto. In order for us to send you paper copies, you must have a current street address on file with us as your “Home” address. Kroger will charge you a $5 fee for the mailing and delivery of each Communication you request.  

E. Updating your contact information

It is your responsibility to keep your primary email address up to date so that we can communicate with you electronically. You understand and agree that if we send you an electronic Communication but you do not receive it because your primary email address on file is incorrect, out of date, blocked by your service provider, or you are otherwise unable to receive electronic Communications, we will be deemed to have provided the Communication to you.

Please note that if you use a spam filter that blocks or re-routes emails from senders not listed in your email address book, you must add us to your email address book so that you will be able to receive the Communications we send to you.
